Landlord Won't Share PAN? Here's How to Still Claim HRA

If your landlord refuses to share their PAN — or genuinely doesn't have one — and your annual rent crosses ₹1,00,000, this is the situation this page is for. Below the ₹1 lakh threshold (under ₹8,333/month), the landlord PAN isn't required at all. The Rule: PAN Is Only Required Above Rs. 1 Lakh Annual Rent

Under Section 10(13A) of the Income Tax Act, the landlord's PAN is mandatory only if your annual rent exceeds Rs. 1,00,000 — that is, if you pay more than Rs. 8,333 per month.

What If Your Landlord Does Not Have a PAN?

Landlords who are senior citizens, agricultural income earners, or individuals with income below the taxable threshold may not have a PAN. If your landlord genuinely does not have one, the Income Tax Department's position is:

  • 1.Your landlord should obtain a PAN — it is free and can be applied for online at the NSDL/UTIITSL portal. Most landlords with rental income above the basic exemption limit are legally required to have one.
  • 2.If your landlord truly cannot obtain a PAN, submit a declaration from the landlord stating their name, address, and reason for not having a PAN. Some employers and the IT Department accept this, though it is not a guaranteed substitute.
  • 3.If your employer does not accept receipts without PAN for rent above Rs. 1 lakh, your employer will deduct TDS on the full HRA amount. You can still claim the exemption when filing your ITR — but you will need to get a refund from the IT Department rather than from your employer.

What If Your Landlord Refuses to Share Their PAN?

A landlord refusing to share their PAN is a common situation, especially for older landlords or those with multiple properties. Legally, if you pay rent above Rs. 1 lakh annually and cannot provide the landlord's PAN to your employer:

  • Your employer will deduct higher TDS on your HRA, treating it as fully taxable income.
  • You can claim the HRA exemption in your ITR (Form ITR-1 or ITR-2) and receive a refund — but this takes months.
  • There is no legal obligation for a landlord to share their PAN with a tenant for their HRA claim — the obligation is the tenant's to report it. If you cannot get it, document your attempts.
